A three-judge panel of the 11th U.S. Circuit Court of Appeals ordered the dismissal of Warren’s lawsuit against DeSantis, saying the case is moot.

Warren’s lawyers warned that embracing DeSantis’ arguments about the 1924 opinion “would invalidate many federal statutes and overrule innumerable” court decisions.

The petition filed Thursday by DeSantis’ lawyers contended that the panel decision was “deeply flawed.”

Also, a footnote in the opinion rejected a conclusion by Hinkle that he would not have authority to reinstate Warren.
