While appellate courts in other parts of the country have issued similar decisions, the panel said it was a first-of-its-kind ruling in the 11th Circuit.
Florida’s children’s health program dates to the 1990s, with subsidized insurance available to families with incomes up to 210 percent of the federal poverty level.
“It is apparent that excessive heat has become more frequent, and if these trends continue, the result will be more heat exposure for the workforce,” the study said.
