  • New York City Mayor Michael Bloomberg's proposed ban on large sugary drinks was struck down Monday by State Supreme Court Justice Milton Tingling.

On Monday, New York State Supreme Court Justice Milton Tingling blocked New York City from implementing rules banning large-sized sugary beverages. According to the New York Times, Justice Tingling said the ban was "arbitrary and capricious."

Tingling wrote in his opinion that the soda rules would apply "only to some food establishments … but not others, like convenience stores." Tingling also wrote that customers refilling sodas, even if the cup is smaller than 16 ounces, would "defeat and/or serve to gut the purpose of the rule."
